H.R.74: Grant's Law
Overview
Grant’s Law would add a new requirement for the Department of Homeland Security (DHS) to detain undocumented individuals that are merely arrested for a crime that would make them eligible for deportation if they were ultimately convicted.
Further, the undocumented person must remain in custody of either DHS or a local authority, for the purposes of the pending legal proceeding, until the “final disposition” of the proceeding. Then, even if the undocumented person is not convicted, DHS will commence or continue removal proceedings and continue to detain the undocumented person until the removal proceedings are completed.
